This web site is for informational purposes only and is intended to give a general overview of benefits available to members of the Public Employee Health Plans("PEHP"). Due to the various plans offered by PEHP to different employers, not all of the information on the site is applicable to all PEHP members. This site does not create contractual rights or obligations of PEHP and its members for benefits or claims. The PEHP Master Policy is the contract between PEHP and its members, which creates and governs the rights and obligations of PEHP and its members is available upon request from PEHP. The information on this site is offered "AS IS", without warranty of any kind. While every precaution has been taken in the preparation of this site, PEHP shall not be liable for any loss or damage caused or alleged to have been caused, directly or indirectly, by the information on this site. The information available on or through myPEHP is the property of PEHP, and is protected by copyright, trademark, and / or other intellectual property laws. Users may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works or otherwise use any information available on or through myPEHP for commercial or public purposes.

3. TAMPERING.

User agrees not to modify, move, add to, delete or otherwise tamper with the information contained in myPEHP. User also agrees not to decompile, reverse engineer, disassemble or unlawfully use or reduce any of the software, copyrighted or trademarked material, trade secrets, or other proprietary information contained in myPEHP.

4. LINKS TO THIRD PARTY SITES.

MyPEHP may contain links that will let you access other Web sites that are not under the control of PEHP. The links are only provided as a convenience and PEHP does not endorse any of these sites. PEHP assumes no responsibility or liability for any material that may be accessed on other Web sites reached through myPEHP, nor does PEHP make any representation regarding the quality of any product or service contained at any such site.

PEHP prohibits unauthorized framing of any information contained on myPEHP or any portion of myPEHP. PEHP reserves the right to disable any unauthorized links or frames. PEHP has no responsibility or liability for any material on other Web sites that may contain links to myPEHP.

Protecting the privacy of our members is important to PEHP. The PEHP Terms of Service notice describes how we use and protect information you provide to us on our Site.

8. EXECUTION OF TRANSACTIONS.

You can only execute transactions, or obtain personal account information, by following the instructions stated within the password protected logon portion of this site. When using myPEHP to execute transactions, problems can occur that are beyond the ability of PEHP to correct. Access to myPEHP may be limited or unavailable during periods of peak demand, systems upgrading, maintenance or other reasons. PEHP shall not be liable for any transaction not executed due to reasons beyond its control, including system failures. If you are not able to complete your transaction due to a system failure; fail to receive written confirmation of a transaction or its execution within ten (10) business days after execution; or receive confirmation of a transaction which you did not request, you must contact PEHP at 1-801-366-7555 or 1-800-765-7347 (TTY:711) immediately.

9. TRANSMISSION OF PERSONAL DATA.

User acknowledges and agrees that by providing PEHP with any personal information through myPEHP, User consents to the transmission of such personal user information, including transmission over international borders, as necessary for processing in accordance with PEHP's standard business practices and the PEHP Terms of Service notice .

10. ACCESS TO PASSWORD PROTECTED/SECURE AREAS.

Access to and use of password protected and/or secure area of myPEHP is restricted to authorized users only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution.

11. LOSS OF PASSWORD

If you become aware of any loss, theft, or unauthorized use of your password, social security number, or account number; immediately notify PEHP at 1-801-366-7555 or 1-800-765-7347 (TTY:711). You are responsible for the confidentiality, and use of your password, social security number, and account number(s).

12. REMEDIES.

PEHP reserves the right to seek all remedies available at law and in equity for violations of the rules stated within this agreement, as well as the right to restrict access to this site from other Internet sites.

13. JURISDICTION/GOVERNING LAW.

These terms and conditions shall be governed and construed in accordance with the laws of the State of Utah, USA, and applicable federal laws without regard to conflicts of law principals. User agrees that any and all proceedings relating to myPEHP and the subject matter contained herein shall be maintained in the courts of the state of Utah or the federal district courts sitting in Utah, which courts shall have exclusive jurisdiction for such purpose.

14. RIGHT TO MODIFY

PEHP reserves the right to modify the rules and regulations governing this site at any time. When modifications appear on this site, users are deemed to be aware and bound by any changes to these rules and regulations.
